Description:

The Georgia ADR Rules distinguish arbitration from mediation because an arbitrator or arbitration panel renders a decision after hearing an abbreviated version of the evidence. In non-binding arbitration, either party may demand trial within the specified period. The rules emphasize that arbitration is adjudicative, while mediation is not.

Practical meaning: non-binding arbitration gives parties a neutral merits-based decision that can promote settlement, narrow issues, or reset expectations, but it normally does not eliminate the right to trial if a party timely rejects or challenges the award under the applicable local rule, court order, or agreement.
